Terms of Use

These terms apply to the Oasis AAC app for iPad (the “App”), the language, voice and picture packages it downloads (the “Content”) and this website, all provided by [COMPANY NAME] (“we”, “us”). By using the App you agree to these terms. If you use the App on behalf of someone else, for example a child, you accept these terms for them.

1. What Oasis AAC is

Oasis AAC is an augmentative and alternative communication tool: it helps people communicate by choosing picture cards or typing, and speaks the result aloud.

2. Not a medical device

The App is a communication aid. It is not a medical device, does not diagnose or treat any condition and does not replace advice from a speech and language therapist or other professional. Do not rely on the App as the only way to call for help in an emergency. A device can run out of power, be muted or be out of reach.

3. Licence

We grant you a personal, non-exclusive, non-transferable licence to use the App and the Content on Apple devices that you own or control, as permitted by the Apple Media Services Terms and Conditions. Apple's standard Licensed Application End User License Agreement applies in addition to these terms; where they differ, these terms apply to the extent allowed by Apple's terms. You may not copy, sell, rent or redistribute the App or the Content, or extract the vocabulary, pictures or voices for use outside the App, except where the law allows it.

4. Third-party components

Some voices, fonts and other components are provided by third parties under their own licences (for example Creative Commons and open-source licences). Their licences and notices are published at [LINK TO THE LICENCES PAGE]. Those licences apply to those components.

5. Purchases and subscriptions

Purchases are made through the App Store. Prices, trial periods, renewal and cancellation are shown before you buy. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period in your Apple account settings. Refunds are handled by Apple under its policies.

6. Your content

Cards, photos, recordings and sentences you create belong to you and stay on your device (see the Privacy Policy). You are responsible for having the right to use the photos and recordings you add, especially of other people. You are responsible for keeping backups; we cannot restore data that was stored only on a lost or reset device.

7. Acceptable use

Do not use the App to break the law, to infringe others' rights, or to attempt to interfere with our servers, for example by bulk downloading or reverse engineering the delivery service.

8. Availability and changes

Once a language and voice are installed, the App works without an internet connection. Downloads and updates depend on our servers and your connection and may sometimes be unavailable. We may improve, change or stop parts of the App or the Content; updates are always optional, and an installed version keeps working until you choose to update it.

9. Disclaimer

The App and the Content are provided “as is” and “as available”. To the extent permitted by law, we make no warranties that the App will be error-free, uninterrupted, or that a word, picture or voice will suit every person or situation. Nothing in these terms limits rights you have as a consumer that cannot be excluded by law.

10. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential loss, or for loss of data, arising from the use of the App. Our total liability is limited to the amount you paid for the App in the twelve months before the claim, or [AMOUNT] if you paid nothing. We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded by law.

11. Ending use

You can stop using the App at any time by deleting it. We may suspend access to downloads if these terms are seriously breached.

We may update these terms. The current version and its effective date are always on this page; if a change is significant, we will tell you in the App.

13. Law and disputes

These terms are governed by the laws of [JURISDICTION]. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live and may bring proceedings there.
